Texas Court Rules on Structured Settlement Market - CBC ...

Recent action by the Texas courts shows how important a competitive market is for structured settlement sales.

A Texas trial court last month rejected efforts by settlement buying company Imperial Finance to claim that its customers must use the firm exclusively to make structured settlement payout deals. Imperial has argued that its customers should not be able to get competitive bids from other structured settlement buyers.

Texas courts have repeatedly said that this restriction of consumer rights goes against a fundamental principle of the industry, which is that those looking to sell all or part of a structured settlement should have access to competitive bids or offers from various structured settlement buyers. In other words, sellers of structured settlement legally have the right to shop around and get offers from other companies.

This recent legal challenge underscores the dedication of state governments to providing a fair market for selling structured settlements. Judges sometimes reject a transaction because it does not give the seller enough of the money in exchange for what he or she would receive over time from a structured settlement. Competition is part of finding an equitable deal that a judge will accept as the basis for a structured settlement sale. Those who want to sell their structured settlement to get cash up front may not have access to the best deals if they can?t shop for competitive offers.

Matthew Fox 'beats women,' 'Lost' co-star says

In a series of blunt posts on his Twitter feed, "Lost" star Dominic Monaghan is accusing his onetime co-star Matthew Fox of beating women.

Monaghan was in the midst of a fan Q&A on Twitter earlier this week when a user going by the screen name Becca wrote, "holla at matthew fox and tell him to get a twitter i beg of you." Monaghan's reply: "he beats women. No thanks."

Becca and Monaghan continued their conversation -- Becca wanted to know "what about all those good times you had together?" to which Monaghan replied, "how do you know we ever did? you don't know either of us. he beats women. not isolate incidents. often. not interested."

Monaghan went on to defend himself against those saying he was making false accusations.

TODAY.com reached out to Fox's manager and attorney for comment, but they have yet to respond.

Fox and Monaghan worked closely together on "Lost" from the series' beginning in 2004. While Monaghan's character Charlie was killed off in the season three finale in 2007, he returned for a number of episodes before the show ended its run in 2010. In a case of art apparently imitating life, Charlie and Fox's character Jack were often at odds with each other.

While "Lost" was on the air, personal conflicts between Monaghan and Fox, if there were any, were never publicized. That said, Fox is no stranger to off-screen controversy. In 2010, a stripper told In Touch magazine that the married actor had an affair with her (which he later denied); in 2011 Fox was charged with assault after allegedly punching a female bus driver in the breasts and groin; and just recently, Fox was arrested for allegedly driving while intoxicated.

Back in the late 2000s, 1992 Hosea Williams Drive was home to the quintessential Kirkwood bar, Aces Bar & Grill. Representative of the influx of young gentrifiers, the smoky dive bar served the local 20-somethings well. But times change and 20-somethings grow up. Enter The Pullman.

Partners and Kirkwood locals Heidi Shonkwiler and Dan Wingate set out to open a community-centric gastropub to match the evolving demographic of Kirkwood. When the pair learned that Aces was going under ?after a weeks-long stint as the kid-friendly Jak?s All In,? they saw their opportunity to build the pub the neighborhood needed. No longer an adults-only dive bar, The Pullman aims to offer a place to share a few pints with friends, as well as a place to park your stroller while you do it.

The Pullman walks that 30-something line between family-friendly enough to bring the kids along for dinner, but young enough to draw the crowd back in for drinks once the little ones are in bed. Wingate and Shonkwiler teamed up with chef Lotinza Clark from Radial Cafe to create a sampling of seasonal pub grub, offering a late-night menu most nights until midnight or later.

Unlike many self-declared gastropubs, shareable small plates are not the focus here, concentrating instead on sandwiches and entrees. The Oh George ($10), the house burger, comes with a man-sized half-pound patty of local beef, thick bacon slices, manchego cheese and a remarkably fresh yet mild jalapeno mayo. I?m pleasantly surprised by the special of the day: a fried chicken sandwich ($10) on toast, topped with tomato and mixed greens, oozing on all sides with melted pimento cheese.

Among the appetizers, a plate of the Sriracha wings ($8) makes for a great starter to split with friends. The sweet and spicy glazed wings keep just enough of the unmistakable kick of the rooster sauce, tempered just enough to satisfy heat lovers without alienating more timid palates. I was more than happy to hog most of our plate of chicken livers ($6), enjoying the light, flash-fried batter dusted with fresh herbs.

You?ll hear no complaints of small portions when the server airlifts the barbecue short ribs ($13) to your table. This impossibly large slab of slow-roasted beef arrives slathered with peach barbecue sauce atop a sweet potato and plantain hash, and can easily feed two adults. At seeing the shocked look in my eyes my server swears, almost apologetically, that I received the largest rib she?d seen them serve. This eats almost like a moist, braised brisket. Taken in human-sized portions, each bite is excellent, but I couldn?t help but picture some starving child across the world as I returned a plate with 2 pounds of meat still on it.

For a place claiming the gastropub title, I wish the beer selection was a little more extensive, currently offering 12 draft beers and a handful of bottles. However, half of the taps are dedicated to local breweries, and the rest offer a rotating selection of some more obscure beers that should keep most craft brew-heads interested.

Cocktails also get the seasonal treatment, and regularly change. The current menu offers multiple light libations, like the Palace ($8), a summery mix of gin, St. Germain and ginger ale, perfect for sipping on a warm afternoon. Or, spice things up a bit with the tequila-based Lightning Slinger ($8), mixed with pineapple juice, ginger liqueur and a dash of coarse ground black pepper.

A few missteps hint that the crew is still getting their feet under them . The blue cheese mayo is noticeably absent from my blackened chicken sandwich ($9) when I peel back the bun, and a bowl of spinach, artichoke and smoked gouda dip ($7) begs for a few more shakes of salt.

While the service is consistently attentive, I couldn?t help but notice the kitchen fall behind at seemingly odd times. One crowded Sunday brunch, I had no trouble getting my plate of peppered steak and eggs ($12), but on a slow Tuesday evening with only a handful of occupied tables, a plate of falafel and hummus ($7) arrives as we pay our check (for which our repentant server did not charge us.)

The Pullman aims to be the pub where all walks of the community can gather, and at that, they surely succeed. Shonkwiler and Wingate know their neighbors well, and have crafted a cozy little neighborhood tavern that everyone in the Kirkwood area should check out.

Late Returns: Ted Cruz Still Cruising For Texas Senate Upset

Last night, Ted Cruz, who is vying for the Republican nomination in the Senate race to determine who will take over Kay Bailey Hutchison's seat, completed his first task -- he forced the establishment favorite David Dewhurst into a July 31 runoff election.

There's no reason that Dewhurst should be quaking with fear, necessarily -- he beat Cruz last night, 45-34 percent and the polls indicate that supporters of third-place finisher Tom Leppert would break Dewhurst's way by a 3-to-1 margin. But those same polls -- conducted by Public Policy Polling -- nevertheless demonstrate that Cruz's path to victory shouldn't be discounted:

It's all about turnout and enthusiasm. We found last week that 49% of Cruz's supporters were 'very excited' about voting for him. Only 27% of Dewhurst's expressed the same sentiment. Among that most enthusiastic group of voters Cruz led Dewhurst 42-37 for yesterday's primary, and trailed only 48-46 in a hypothetical runoff contest. It's hard to say what turnout will be in July but assuming it's lower than it was yesterday that will work to Cruz's advantage due to the passion of his supporters.

In addition, PPP found that, "Cruz clearly had the momentum in the closing week of the race."

There are some other Senate races (Indiana, Nebraska) in which Democrats believe that a more extreme candidate winning the GOP primary creates an opportunity. That won't be the case in Texas -- whoever wins the runoff is going to be Texas' junior senator.

Let's Give The Whole Third-Party Thing Another Try: This planned independent voters group sounds enough like Americans Elect that it felt it was necessary to immediately and publicly announce that it is not like Americans Elect. It does sound a LOT like Americans Elect, though. However, it is being headed up by "veteran ad-maker Bill Hillsman," and Hillsman has worked with Kinky Friedman in the past, all of which means there's at least a better-than-even chance that they will be way more interesting that most political efforts. "Fox And Friends" Campaign Ad Sows Misgivings: The Baltimore Sun's David Zurawik, who has defended Fox News in the past when the Obama White House threw up access roadblocks, isn't happy about "Fox And Friends" going all Romney Super PAC on viewers, saying, "Any news organization that puts up this kind of video is rotten to the core." And while Hot Air's Ed Morrissey doesn't disagree with the content of the spot, nevertheless hews to his well-known straight-shooter tendencies, saying, "I know the initial response will be that other news organizations offer biased perspectives and hagiographies of Obama that go well beyond a single video ? and that response is entirely valid.
